All the currently approved SANAS Verification Agencies (VA)  received approval from SANAS on 4 May 2015 to issue BEE Certificates in terms i to the Amended Codes of Good Practice of 11 October 2013.

This means that they can issue BEE Certificates  i.t.o. Code 000- 500 for EME’s and Generics as per the New Classifications.

The DTI issued a statement yesterday w.r.t. measurement of Companies under the old Codes. When VA measure  an EME or Generic we may use the Fin Year ending before 30 April 2015. 

The DTI has established self-service kiosks at the DTI campus to issue EME exemptions  that is not yet working at this stage. The intention is: 

-EME exemptions are to be issued by CIPC;

- CIPC will only issue exemptions on 2 cases;

  • On registration of a new entity;
  • On submission of annual returns to SARS and
  • All other EME certificates and QSE will continue to be issued by the industry under the current Codes, until they are phased out in a year's time.

In terms of the Preferential Procurement Policy Framework Act (PPPFA) and its 2011 Regulations, for tender purposes, Affidavits currently do not serve as sufficient evidence and the Government Tender Boards. The PPPFA will first  need to align itself to the Revised Codes.

 We have summarized the EME categories under the Amended Codes below:

  • DTI EME’s can be measured on the new codes under 10 million and will still need a EME Certificate. The viewpoint here is that a sworn affidavit is not meaningful evidence to prove turnover and black ownership (which will include black female ownership) and there is concern that this will encourage fronting practices. This does not allow for the evidence to be “knowingly questioned “for Verification Purposes and will not apply to the principle of sufficient evidence. A sworn statement is also not regarded as independent confirmation of any fact as required by the Amended Codes therefor all credible VA’s will ask for proof.
  • DTI EME’s can be measured on the old codes if their financial year ends before or on 30/4/2015.    5 million. (CIPC documents, ID’s and Auditors letter). It is also important to Note that all EME ‘s will from 1 May 201`5 automatically be regarded as empowering suppliers. 
  • Sector Codes EME’s  must be measured on the old sector codes until October 2015 and until further notice. .
